God only knows how many times I LOST LS Leave when I chose to move to a better job..
If an employee leaves with less than 5 years service they do not qualify for long service leave. That is the entire concept of long service leave, it rewards "long service".
If an employee leaves with more than 5 years service they must be paid their long service leave.
If an employee leaves with more than 10 years service they may well have already taken some LS leave, but must be paid for any they are still owed.
If you have left jobs where you were entitled to LS leave (i.e. more than 5 years ervice) and were not paid for it, your employer was breaking the law as I understand it. Of course the rules may have changed, may be different for each state, or may be related to AWARDs etc., this being Australia we do not like to standardise anything!
